Internationale Petition, für eine faire Gerichtsentscheidung

an das Bezirksgericht Tokyo, Collegiate Sektion 1E der 33. Devision für Zivilsachen

Wir, die Bürger Japans und Bürger der Welt, fordern eine faire Gerichtsentscheidung bei der Verleumdungsklage eingereicht von Herrn Yoshiaki Yoshimi, Professor der Geschichte an der Chuo Universität in Tokyo gegen Herrn Fumiki Sakurauchi, ehemaligen Nationaltagsabgeordneten und Mitglied der Japanischen Restaurationspartei. Das Gericht wird am 20. Januar 2016 ein Urteil fällen. (Gerichtsfall mit u. a. Entschädigungsforderung 2013 wa Nr. 19679)

Der Kläger, Prof. Yoshimi, hat sich seit vielen Jahren dafür eingesetzt, durch sorgfältige Forschungen der historischen Dokumente und zahlreiche Zeugenaussagen die wahre Geschichte der sog. „Trostfrauen“ im II. Weltkrieg aufzudecken. Damit hat er dazu beigetragen, Hoffnungsflamme bei den betroffenen Frauen in Asien aufrechtzuerhalten. Sein Werk hat auch dazu beigetragen, dass sich Japan endlich mit der eigenen Geschichte ehrlich auseinandersetzt.

Doch der Angeklagte, Herr Sakurauchi, bezeichnete das Klägerswerk als eine Fabrikation und sagte vor Gericht aus, dass jene Teile des Yoshimis Werk, die die Trostfrauen als sexuelle Sklaven darstellen, wären eine komplette Fabrikation.

Ein Lebenswerk eines Forschers und dessen Schlussfolgerungen als eine Fabrikation zu bezeichnen ist nicht nur eine schwerwiegende Verleumdung.

Es handelt sich hier um einen eklatanten Angriff auf allgemeine Werte, die die Wissenschaft an sich in der Gesellschaft verkörpert.

Wir appellieren an das Gericht nachdrücklich, zu einem fairen Urteil zu gelangen, das Gerechtigkeit unterstützt und historische Wahrheit respektiert.

On January 20, 2016, there will be a long-awaited court ruling on the defamation suit filed by Yoshiaki Yoshimi, professor of history at Chuo University, against Fumiki Sakurauchi, a former member of the House of Representatives and the Japan Restoration Party.

Professor Yoshimi is a leading expert on the issue of Japanese “comfort women” and is widely respected by his peers around the world for his groundbreaking work. However, in spite of such achievements, he was publicly disgraced by Sakurauchi, who stated in front of the Foreign Correspondents’ Club of Japan (FCCJ) that his work is a “fabrication,” and continued to make derogatory comments in front of a court with no intention of withdrawing his remarks. Moreover, Sakurauchi, the defendant, insisted that “the theory of equating ‘comfort women’ with sexual slaves is a fabrication,” and that “the part of Yoshimi’s work which claims ‘comfort women’ were sexual slaves is completely a fabrication.”

The claim that the Japanese system of “comfort women” was not an institution of sexual slavery ignores the history of violence and oppression caused by the Japanese state and military, and inflicts further harm upon its victims.

If Yoshimi does not win this case, not only will he be denied the dignity that he deserves, but it will also deny dignity and honor to the victims who have been hurt by the defendant’s statements.

International Petition Demanding a Fair Ruling from the Court

To: Tokyo District Court, Collegiate Section 1E of 33^rd Civil Division

We, the citizens of Japan, and citizens of the world, demand that the court arrive at a fair and just decision on the defamation suit filed by Yoshiaki Yoshimi, professor of history at Chuo University, against Fumiki Sakurauchi, former member of the House of Representatives and Japan Restoration Party—which will receive a ruling on January 20, 2016 (CASE CLAIMING DAMAGES ETC. 2013 (wa) No. 19679).

The plaintiff, Professor Yoshimi, has done more than anyone to uncover the reality of the history of Japanese “comfort women” through the careful investigation of documents and testimonies. He thus brought rays of hope to the victims and demonstrated Japan’s conscience to the world. However, the defendant, Sakurauchi, made remarks asserting that the plaintiff’s work is a “fabrication” and stated in court that “the part of Yoshimi’s work which claims ‘comfort women’ were sexual slaves is completely a fabrication.”

Dismissing a scholar’s lifelong work and the conclusions resulting from it as a “fabrication” is not only a serious act of defamation, but also an outrageous attack on the societal value of scholarship in general.

The world’s eyes are upon Japan and its judiciary to see what kind of ruling it will produce against the defendant, who has claimed as “fabrication” the lifework of a world-renowned expert on the issue of “comfort women.”

We strongly plead the court to arrive at a fair ruling—a judgment that upholds justice and true history for the world to see.

요시미 요시아키 교수(일본 츄오대학교)님이 사쿠라우치 후미키 당시 일본유신회 중의원의원을 명예훼손으로 제소한 소송이 2016년 1월 20일, 드디어 판결을 맞이하게 되었습니다.

요시미 교수님은 일본군’위안부’ 문제 관련 분야의 제일인자로서 일본 뿐만 아니라 세계적으로 신뢰 받는 연구자입니다. 그러한 사람의 저서를 사쿠라우치 씨는 외국특파원협회 기자회견에서 ‘날조’라고 발언하였습니다. 이것은 명백히 요시미 교수님의 명예를 훼손한 것입니다. 그럼에도 불구하고 발언을 철회하기는 커녕, 법정에서도 또 다른 명예훼손이라고 해야 할 발언을 되풀이했습니다. 또 피고측은 ‘위안부=성노예 설은 날조’라며, 요시미 교수님이 저서 안에서 ‘위안부는 성노예라고 단정한 부분은 날조’라고도 주장하기 시작했습니다.

일본군 ‘위안부’는 성노예제도가 아니라는 주장은 일본 국가・군대가 과거에 저지른 지배와 폭력, 그 역사를 외면하는 것이며 피해자를 다시 한번 모욕하는 것입니다.

만약 이 재판에서 패소한다면 요시미 교수님의 명예회복이 이루어질 수 없을 뿐만 아니라, 피고측의 주장에 의해 다시 한번 훼손된 피해 여성들의 명예도 회복할 수 없습니다.

법원에 공정한, 그리고 역사와 세계에 부끄럽지 않는 판결을 내도록 요청하는 국제 서명에 동참해 주십시오.

요시미 요시아키 교수(츄오대학교)가 사쿠라우치 후미키 당시 일본유신회 중의원의원을 명예훼손으로 제소한 재판(헤세이 25년 (와) 제19679호 손해배상 등 청구사건)이 2016년 1월 20일, 판결을 맞이하게 되었습니다. 이를 앞두고, 우리 일본 시민, 그리고 세계 시민은 법원이 공정하고 정의로운 판결을 내도록 간절히 요청합니다.

원고 요시미 요시아키 씨는 면밀한 자료조사와 증언 청취 등에 의해 일본군 ‘위안부’ 문제의 실태 해명에 누구보다 크게 공헌하였으며, 세계에 일본의 양심을 과시해 왔습니다. 또 일본군’위안부’ 피해자들에게는 묻혀진 진실을 밝혀주는 희망의 빛으로서의 역할을 해 오셨습니다. 그런데 피고는 이 원고의 저서를 ‘날조’라고 발언하고, 또 본 법정에서는 원고가 “위안부는 성노예라고 단정한 부분은 날조”라고도 말했습니다.

연구자의 연구업적을 날조라 공언하고, 더욱이 그 업적의 결론이라고도 할 수 있는 명제를 날조라고 지적하는 행위는 연구자에 대한 중대한 명예훼손일 뿐만 아니라 연구자의 사회적 존재 자체를 부정하는 폭력입니다.

일본군‘위안부’문제와 관련한 연구자로서 국제적으로도 명망높은 원고의 바로 그 업적을 ‘날조’라고 단정한 피고에 대해서 일본의 사법이 어떤 판단을 내릴지 전 세계 시민들도 주목하고 있습니다.

법원이 역사와 세계에 부끄럽지 않는 판결을 내도록 진심으로 요청합니다.
